General Terms and Conditions – TaKeTiNa Institut GbR
for educational and training events such as courses, seminars, workshops, and trainings – online or in-person
1. Registration and Conclusion of Contract
We recommend registering early, as the number of participants for our events may be limited. Registrations are processed in the order in which they are received. If an event is already fully booked, you may request to be placed on a waiting list.
Registration for our events is generally done via the online registration form on our website or in writing (by email or post). A binding contract is only concluded once we send you written confirmation of your registration (via email), which also includes an invoice for the participation fee. Until the registration is confirmed by TaKeTiNa Institut GbR, it remains non-binding and there is no entitlement to participation.
Our events are generally open to all interested parties. However, TaKeTiNa Institut GbR reserves the right to decline a registration in individual cases without stating reasons.
2. Participation Fees and Payment Terms
The participation fees published at the time of registration apply. Early booking discounts or special rates for certain groups (e.g., couples, students, trainees, or groups) are granted as stated in the respective event description. All prices are final; no VAT is charged as our services are exempt from VAT under § 4 No. 21 a) bb) of the German VAT Act (UStG).
Unless otherwise agreed, invoices are payable in full within 10 days of the invoice date. For last-minute registrations (fewer than 10 days before the event), please email us proof of payment (e.g., transfer receipt) or bring it with you to the event.
Payments can be made by bank transfer to the account specified on the invoice. Alternatively, payment by credit card is available (processed via Stripe Payments Europe). No personal Stripe account is required for credit card payments. Please note that TaKeTiNa Institut GbR remains your contact for all customer service matters, even when using these external payment providers.
3. Cancellation by Participant
If you wish to cancel your registration (withdraw from the contract), you must notify us in writing (e.g., via email or letter). The effective date of cancellation is the date we receive your notice.
For cancellations received up to 30 calendar days before the start of the event, a processing fee of €50 will be charged (this amount will be deducted from any paid fees or invoiced separately). For cancellations received less than 30 days before the event, the full participation fee is due unless you provide a suitable replacement participant. If a replacement person who meets our requirements is accepted by us, the processing fee is waived.
Failure to attend or early departure from the event does not entitle the participant to a refund or reduction of the participation fee. Missed sessions cannot be made up.
4. Cancellation or Changes by the Organizer / Minimum Participant Number
TaKeTiNa Institut GbR reserves the right to cancel events or make changes to the schedule or content for good cause. Good cause may include, in particular: failure to meet the minimum number of participants, force majeure, illness or unavailability of the course leader, or other unforeseeable events beyond our control. In such cases, we will inform registered participants as early as possible, and no later than 14 days before the scheduled event date.
If we cancel an event, any participation fees already paid will be refunded in full. No further claims may be asserted; in particular, we do not reimburse costs incurred by participants due to the cancellation (e.g., travel or accommodation costs).
If an event cannot be held as planned due to low participant numbers or other urgent reasons, we may postpone the date, shorten the event while maintaining its content, or provide a replacement date or instructor. In such cases, participants may either accept the change (e.g., attend the event at the new date or in shortened form) or withdraw from the contract. If a withdrawal occurs due to such changes, any paid fees will be refunded.
We reserve the right to make short-notice organizational or program-related changes (including changes to the event venue or times), provided these do not materially alter the overall character of the event. We will inform all registered participants in good time about any such changes. Please ensure your registration includes up-to-date contact information (email and phone number).
5. Limitation of Liability
Each participant is responsible for deciding to what extent they engage with the offered processes, and they participate at their own risk. The organizer is not liable for damage to property or health. Participants agree to follow all instructions given by the organizer. The organizer accepts no liability for travel to and from the event location.
If you are undergoing long-term medical treatment due to a physical or psychological condition, please provide a certificate from your attending physician confirming your ability to participate.
6. No Right of Withdrawal for Time-Bound Events
According to § 312g (2) No. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for contracts involving the provision of leisure activities, where the contract specifies a specific date or period for performance.
As all events offered by the TaKeTiNa Institute (e.g., courses, seminars, retreats, workshops, and training programs) take place on fixed dates, no right of withdrawal under distance selling law applies.
Only the cancellation terms set out in section 3 of these terms and conditions apply.
7. Data Protection
TaKeTiNa Institute GbR is committed to protecting your personal data. We collect, process, and use your personal information exclusively in accordance with the applicable data protection laws, in particular the EU General Data Protection Regulation (GDPR). Personal data of participants (such as name, contact details, and any relevant health information) is collected and used only to the extent necessary for organizing and conducting the event and for fulfilling our contractual obligations. We will not disclose your personal data to third parties unless it is necessary for the performance of the contract (e.g., to co-organizers or service providers assisting with the event) or we are legally required to do so.

8. Final Provisions
These terms and any contracts concluded under them are governed by the laws of the Federal Republic of Germany, except where consumer protection laws of your country of residence take precedence. The contractual language is German.
Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the applicable statutory provisions shall apply. The same applies in the event of an omission (gap) in these Terms and Conditions.
This English version of the Terms and Conditions is a translation of the German Allgemeine Geschäftsbedingungen. Both language versions are intended to have the same meaning. In the event of any discrepancy or difference in interpretation, the German version shall prevail.
