GENERAL TERMS AND CONDITIONS
OF TAKETINA INSTITUTE GBR AND TAKETINA ONLINE LEARNING GBR

  1. Registration

We recommend early registration for all events, as the number of participants is limited for some events. Registrations will be considered in the order they are received. If an event is currently fully booked, please write to office@taketina.com to be put on the waiting list. Often, spots become available at short notice. Please use the booking form for the respective event for your registration whenever possible. You will then automatically receive a booking confirmation and an invoice in advance by email. Our events are generally open to all interested parties. We reserve the right to refuse participants without giving reasons.

  1. Prices / Payment

There are often two prices for our offers. The lower rate applies to early bookings until the announced date. Special conditions are available for certain events for couple members, students, apprentices, and groups upon request. If you are unable to pay the stated amount for an event, installment payments or a discount may be possible in justified cases (with proof). The course fees do not include VAT, as we are not subject to VAT with the TaKeTiNa Institute GbR (§4 No. 21 letter a, double letter bb). The total costs must be paid within 10 days of invoicing, unless otherwise agreed. For short-term bookings, we ask for proof of payment by email. Payment options PayPal and credit card are offered through our external payment processor PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg and Stripe Payments Europe, 1 Grand Canal Street Lower, Dublin 2, Co. Dublin, Ireland. You do NOT need an account with PayPal or Stripe. For direct debit, it is also necessary during the ordering process to authorize PayPal Plus to collect the payments to be made by you for the purchase by direct debit. Please note that we are still responsible for general customer inquiries even when paying via PayPal, direct debit, and credit card via Stripe.

  1. Withdrawal / Changes / Cancellation

A withdrawal notification by the participant must be made in writing. Up to 30 days before the event, a processing fee of 50,- EUR is due, after that the full fee is due unless a substitute person is provided. If an event is cancelled, the participants will be notified in writing or by phone. If an event does not take place, the TaKeTiNa Institute will refund the course fees. Further claims cannot be made. Non-use of the whole or part of the services offered does not entitle to any replacement claims, deductions, or refunds. Online products are excluded from withdrawal and exchange. The information in the event listings on the Taketina website corresponds to the most current status. Despite the greatest care, short-term changes in event dates/locations, etc. are possible. We therefore reserve the right to make program changes. Of course, we will inform all registered participants about changes – please always leave us your phone number and an email contact address. In the event of underbooking of an event, we reserve the right to shorten the total duration with unchanged contents. In this case, the participants have an extraordinary right of termination.

  1. Accommodation

Participants must organize accommodation for seminars themselves. On request, we can send a list of private accommodations, hotels, and guesthouses.

  1. Disclaimer

Each participant decides to what extent he/she engages in the offered processes and is responsible for themselves. The organizer is not liable for damage to property and health. He/she undertakes to observe all instructions given by the organizer. The organizer assumes no liability for travel to and from the course location. If you are undergoing continuous medical treatment for physical or psychological illnesses, please provide a certificate from the treating doctor about your ability to participate.

  1. Right of Withdrawal

In addition to the right of withdrawal, consumers within the meaning of § 13 BGB have a right of withdrawal, provided the contract was concluded by letter or email. A consumer within the meaning of the law is any person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. The right of withdrawal expires prematurely if the contract is completely fulfilled by both sides at your express request before you have exercised your right of withdrawal.

The declaration of contract can be revoked within 14 days without stating reasons with a clear declaration in text form (e.g., letter, fax, email). The deadline begins after receipt of this instruction in text form, but not before the conclusion of the contract and also not before fulfillment of our information obligations according to Article 246 § 2 in conjunction with §

1 Paragraph 1 and 2 EGBGB and our obligations according to § 312g Paragraph 1, Sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To comply with the withdrawal period, it is sufficient to send the withdrawal in time. In the event of an effective withdrawal, the services received by both parties must be returned. Limitation of the statutory right of withdrawal for booking appointments. Like any organizer of courses, seminars, workshops, and other offers, the implementation of which is tied to a specific date, we need planning certainty for proper execution. For seminars, courses, workshops, and other date bookings, therefore, a limited right of withdrawal applies, as it is a matter of services to be provided within a specified period. As a customer, you have the right to revoke your declaration of intent aimed at concluding the contract in writing within 2 weeks of your booking, provided this date is at least 4 weeks before the booked course, seminar, or workshop. The time of the withdrawal is determined by the time the order is received. Special Notes: Your right of withdrawal expires prematurely if the contract is completely fulfilled by both sides at your express request before you have exercised your right of withdrawal.

To exercise the right of withdrawal, the TaKeTiNa Institute must be informed of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email) using the contact details provided below. You can use the sample withdrawal form provided below, but it is not mandatory. If you use this option, we will immediately send you a confirmation of the receipt of such a withdrawal. Regardless of this, the cancellation fee is due.
